Your presence on our website, including your use of Neula System via the service provided on our website (“Service”) may be connected with processing of personal data.

Please find below information regarding such processing, including purposes, scope and manners of processing as well as your rights connected with such processing.

In addition, this Privacy Policy covers information on the cookie files used on our website.

I. Data controller

The controller of your personal data shall be JT Weston sp. z o.o. with its seat in Warsaw, al. Jana Pawła II 29 (00-867 Warsaw) („JT Weston”). You can contact JT Weston via e-mail: kontakt@jtweston.pl or at the address indicated above.

II. The purposes of processing and the legal basis for processing

Your data will be processed by JT Weston for the following purposes:

  • conclusion and performance of the agreement on provision of services by electronic means concerning making all functionalities of Neula System available by JT Weston through the Service and keeping Neula System user’s account – the legal basis for such processing is necessity to perform by JT Weston the agreement with the person with which the agreement was concluded (referred to in art. 6 item 1 let. b) of GDPR) or legitimate interest of JT Weston referred to in art. 6 item 1 let. f) of GDPR consisting of making the provision of services possible, in case an entity on behalf of which or at the request of which the user of the Service acts, is the party to the agreement on the provision of services by electronic means,
  • undertaking actions necessary for JT Weston to handle your requests and questions (including those sent to JT Weston via on line contact form), to handle complaints, to archive correspondence, to analyse the quality of our services – the legal basis for such processing is legitimate interest of JT Weston referred to in art. 6 item 1 let. f) of the GDPR covering the need to reply to requests and answers addressed to JT Weston,
  • verification whether your data were used for the purpose of creation of Service user’s account – the legal basis for such processing is legitimate interest of JT Weston referred to in art. 6 item 1 let. f) of the GDPR in prevention of use of dem version of Neula System for a period longer that indicated in the terms of service of Neula System,
  • undertaking analytical and statistical actions as well as securing the safety of the Service as an IT system as well as managing the System (in general, system logs containing information about the activity of the user in the Service and on our website will be processed for this purpose) – the legal basis for such processing is legitimate interest of JT Weston referred to in art. 6 item 1 let. f) of the GDPR covering performance of analysis of users’ activity in order to improve the functionalities of the Service,
  • performance of obligations imposed on JT Weston resulting from the provisions of the law, in particular tax and accounting provisions – the legal basis for such processing are legal obligations of JT Weston resulting from the law (referred to in art. 6 item 1 let. c) of GDPR),
  • potential identification, assertion or defence against claims – the legal for such processing is legitimate interest of JT Weston covering the possibility to identify, assert and defend against claims (art. 6 item 1 let. f) of GDPR).

III. Data retention

The period of retention of your personal data will depend on the purpose of processing of personal data.

Your personal data will be processed for the purpose of:

  • conclusion and performance of the agreement on provision of services by electronic means concerning making all functionalities of Neula System available by JT Weston through the Service and keeping Neula System user’s account – until deletion of the System user’s account. JT Weston may extend this period by statutory limitation period of claims, against JT Weston or possessed by JT Weston, resulting from the law, connected with the agreement, if the processing of such data is necessary to identify, assert or defend against such claims;
  • undertaking actions necessary for JT Weston to handle requests and answer questions (including those sent to JT Weston via on line contact form), to handle complaints, to archive correspondence, to analyse the quality of our services – during the period needed to provide the answer, no longer than 30 days, however JT Weston may extend this period by statutory limitation period of claims, against JT Weston or possessed by JT Weston, resulting from the law, if the processing of such data is necessary to identify, assert or defend against such claims;
  • verification whether your data were used for the purpose of creation of Service user’s account – during the period of one year as of deletion of the Service user’s account;
  • undertaking analytical and statistical actions – during the period of 3 months as of the deletion of the Service user’s account;
  • performance of obligations imposed on JT Weston resulting from the provisions of the law, in particular tax and accounting provisions – during the period resulting from the law and/or during the statutory limitation period concerning the obligations resulting from such provisions of the law;
  • potential identification, assertion or defence against claims – during the statutory limitation period concerning claims against JT Weston and/or claims possessed by JT Weston towards third parties, resulting from the law.

IV. Recipients of data

Your personal data may be provided to entities which render services for JT Weston, e.g. IT services, including cloud platform services, entities rendering legal services as well as other external advisors of JT Weston.

Your personal data may be also provided to public and administrative bodes if such an obligation results for JT Weston from the provisions of the law and/or it will be necessary for JT Weston in order to assert, identify and/or defend against claims.

V. The rights of the data subject

You have the following rights connected with the fact that JT Weston processes your personal data:

  • right to object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning you which is based on legitimate interest of JT Weston;
  • right to receive confirmation whether JT Weston processes your personal data as well as the right to receive access to such data and their copy;
  • right to demand that your personal data is rectified or supplemented, if incomplete;
  • right to erase your personal data;
  • right to demand restriction of processing of your personal data;
  • in case processing of your data is carried out by automated means based on your consent or agreement – right to demand transmission of your data, including right to obtain the data from JT Weston in a structured, commonly used and machine-readable format (e.g. readable on the computer), which we received from you and right to transmit such personal data to other controller without hindrance from JT Weston and right to demand that your personal data is transmitted by JT Weston to other controller, where it is technically feasible.

In order to exercise the above rights, please contact JT Weston using the contact details referred to in point I above.

You have also the right to lodge a compliant to personal data protection supervisory authority (in Poland: the Chairman of Office for Personal Data Protection).

VI. Voluntary provision of data

Providing personal data in the form of: name, company name and e-mail address in the registration form is voluntary, but necessary to submit the registration form and conclusion of the contract concerning the use of demo version of Neula System. The failure to do so will result in the inability to conclude a contract and create a User Account. Providing other personal data is voluntary or occurs automatically in connection with use of the Service.

VII. Profiling and automated decision making

JT Weston will not make decisions which would result in legal consequences for you and/or would affect you in a similar manner, solely based on automated processing, including profiling.

VIII. Information on the transfer of data outside European Economic Area

Your personal data will not be processed outside European Economic Area.

IX. Information on use of cookie files

Cookie files are small text files installed on the end device used for browsing the website or for use of application. Cookies usually contain the name of the internet service domain from which they come from, period of storage on the end device and unique identifier. The operations of our website and the Service is connected with use of cookie files.

  1. JT Weston uses two basic types of cookies files on the Service’s website:
  2. session files – temporary files stored in the user’s end device until logging out, leaving the website and application or turning off the software (web browser);
  3. permanent files – stored in the user’s terminal device for the time specified in the cookie file parameters or until the user deletes them.

  5. necessary for the operation of the service and applications – enabling the use of the Service, e.g. authentication cookies used for services requiring authentication
  6. functional – allowing ‘remembering’ the settings selected by the user and personalizing the user interface, e.g. in the scope of the selected language or region of the user’s origin, font size, the appearance of the website and applications, Service settings, etc.;
  7. analytical – allowing statistical analysis of use of our website, including with use of Google Analytics tool (more information on the rules of operation of this tool is available at https://support.google.com/analytics/answer/6004245), we use Google Analytics tool with settings making your IP address anonymized.

By using the Service and/or our website, the user consents to the placement of cookies on their end device and the use of information stored in them.
